Agreement to Terms
By downloading, installing, or using TrakMiles ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Description of Service
TrakMiles is a mileage tracking application designed to help users record, categorize, and report vehicle mileage for business, personal, or tax purposes. The App provides GPS-based trip tracking, mileage reports, and optional cloud backup features.
Your Data Ownership
You own your data. All trip data, mileage records, and reports you create using TrakMiles belong entirely to you. We do not claim any ownership rights to your content.
You retain full control over your data and may export, delete, or modify it at any time through the App's features.
Your Data Responsibility
You are responsible for your data. This includes:
- Backup Responsibility: While we provide backup mechanisms (Google Drive integration), you are responsible for ensuring your data is regularly backed up. We strongly recommend enabling automatic backups.
- Data Accuracy: You are responsible for the accuracy of trip purposes, categories, and any information you enter.
- Tax & Legal Use: You are responsible for ensuring your mileage records meet any applicable tax authority requirements (such as IRS regulations). TrakMiles provides tools to help, but we do not guarantee compliance with any specific regulations.
- Device Security: You are responsible for maintaining the security of your device and any accounts used with the App.
Subscription & Payments
- TrakMiles offers a free trial period followed by subscription-based access.
- Subscriptions are billed through Google Play and are subject to Google Play's terms.
- You may cancel your subscription at any time through Google Play.
- Upon cancellation, you retain access until the end of your current billing period.
- Refunds are handled according to Google Play's refund policies.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's functionality
- Create fraudulent or misleading mileage records
- Share your account credentials with others
GPS & Location Services
- The App requires location permissions to track mileage accurately.
- GPS accuracy may vary based on device hardware, environmental conditions, and other factors.
- We do not guarantee the absolute accuracy of mileage calculations.
- You should review trip data for accuracy, especially for tax or reimbursement purposes.
Third-Party Services
The App integrates with third-party services including:
- Google Play Services
- Google Sign-In
- Google Drive (for backup)
- Google Maps
- Google Firebase
Your use of these services is subject to their respective terms of service.
Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted or error-free
- Mileage calculations will be 100% accurate
- The App will meet any specific tax authority requirements
- Your data will never be lost (hence the importance of backups)
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of data, revenue, or profits
- Tax penalties or audit issues related to mileage records
- Any damages exceeding the amount you paid for the App in the past 12 months
Indemnification
You agree to indemnify and hold harmless TrakMiles and its developers from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of significant changes through the App or via email.
Termination
We reserve the right to terminate or suspend your access to the App for violation of these Terms. You may stop using the App at any time by uninstalling it and canceling any active subscription.
Governing Law
These Terms shall be governed by the laws of the United States. Any disputes shall be resolved in the appropriate courts.
